If You Rent, You're Probably A Potential Victim Of This Scam

Did you know 2.7 Million people were evicted in 2014

A 'fine print' Lease Clause allows the Landlord/Owner to go after the tenant for unpaid rent for the entire lease period, though the tenant receive no contractual services in exchange for payment.

Landlords and Real Estate Attorney refer to this as a Contractual Penalty Clause. I term it a 'DOUBLE BILLING SCAM'.

The landlord is able to turn around, rent the apartment again, and collect 2 rents for a single apartment.

I reckon at $700 a month rent, and eviction 6 months into the lease, the EVICTION INDUSTRY is worth $10 BILLION DOLLARS A YEAR to scam artist hiding under dubious legality. Judges and Legislators haven't moved on this issue, because it would reduce attorney's income.

Eviction occurs as a Normal Risk of doing business as a Landlord and is not some special circumstance which justifies a windfall.

If the landlord wants to engage a prospective tenant with a 1) spotty employment record 2) overburdened monthly expenses (50% income spent on rent or more) 3) criminal record, the Landlord assumes that risk, not the Tenant. Financial and other types of evictions place a permanent black mark on the tenants abilty to rent in the future.

With the hardships of the economy today, scarce affordable housing,the epidemic of homelessness, many tenants rent whatever apartment is available, without upholding their rights.


My radical interpretation, the Landlord has committed 'Fraud by Inducement', because of the increased likelihoood of substandard Tenant default.

I believe a contract by 'coercion' negates the basic principles of Contract Law.

We need to reconsider this lease clause, like we outlawed Predatory Lending, which is now illegal.
